Federal Judge Rules In Favor of Ultimate Support Systems in Utility Cart Battle

Loveland, CO, April 1, 2010 - Gary-Michael Dahl filed a request last February in his federal lawsuit against Ultimate Support Systems asking the court to issue a restraining order and a preliminary injunction preventing Ultimate Support Systems from selling its new "ULTI-CART" utility cart. Today, the federal court in Los Angeles denied Dahl's request. In its 19-page order, the court concluded that Dahl "...fail[ed] to demonstrate a likelihood of success on the merits of any of his claims, or that he will suffer irreparable harm if a TRO or an injunction is not issued..."
Ultimate Support's CEO, Michael Belitz, commented, "We are very pleased with the court's detailed ruling denying Dahl's request for a TRO. Ultimate Support intends to move forward aggressively with sales of its new utility cart, which we introduced in January at the NAMM show in Anaheim. We also intend to pursue our own claims against Dahl for the damages that he has caused." In the lawsuit, Ultimate Support has filed counterclaims against Dahl including tortious interference with contracts and economic relations and unfair competition. No trial date has been set in the case.
